The short version
- BalePick runs the marketplace: suppliers list pre-loved apparel, buyers purchase it, and we review listings, inspect every order at our hub and handle payment.
- Prices, charges and supplier payouts are in US dollars. Shipping and estimated import duty are shown before you pay.
- Buyers can report a problem within 5 days of delivery. Suppliers are paid after that window closes with no open report.
- Keep conversations and payments on BalePick. Sharing contact details to trade off the platform is not allowed.
- This summary is for convenience only; the full terms below are what apply.
1. Introduction and acceptance
These Terms & Conditions (the "Terms") govern your access to and use of the BalePick website, mobile applications and related services (together, the "Platform"). By creating an account, placing an order, listing stock or otherwise using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy.
If you use the Platform on behalf of a business, you confirm that you are authorised to bind that business, and "you" includes it. If you do not agree to these Terms, you must not use the Platform.
2. Who we are and our role
The Platform is operated by Balepick LLC ("BalePick", "we", "us"). BalePick is a business-to-business marketplace that connects suppliers of pre-loved and vintage apparel with resellers and other trade buyers across borders.
Suppliers sell their own stock; the contract of sale for goods is between the buyer and the supplier. BalePick provides the marketplace, reviews listings, inspects orders at our hub, arranges onward delivery, collects payment from buyers and releases supplier payouts under these Terms.
BalePick is not the manufacturer of any item and does not take ownership of goods passing through our hub, except where we expressly say so for a particular order.
3. Definitions
- Buyer — a person or business with a buyer account that purchases stock on the Platform.
- Supplier — a person or business with an approved seller account that lists stock for sale. "Seller" means the same.
- Listing — an offer of stock published on the Platform, including its photos, walkthrough video, description, grade, quantity and price.
- Exact lot — a listing of one specific lot that is sold whole, exactly as described and shown.
- Representative listing — a listing whose photos and video show a sample of the stock; buyers choose a quantity and the pieces supplied match the declared category, brand mix, size range and grade.
- Order — a purchase placed at checkout. An order with more than one supplier is split into a separate shipment for each supplier.
- Hub — a BalePick facility where orders are received, inspected and prepared for onward delivery.
- Report window — the 5 days after delivery during which a buyer may report a problem with an order.
- Store credit — a US-dollar balance on a buyer account that can be spent at checkout on the Platform.
4. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Platform. The Platform is intended for trade and business purchases; you are responsible for any licences, registrations or permits your business needs to buy, import or resell goods.
Buyer and supplier accounts are separate. A buyer account is used to purchase; to sell you must register a seller account and complete supplier verification. A buyer account cannot be converted into a seller account.
- Give accurate, current and complete information when you register and keep it up to date, including your delivery addresses.
- Keep your password and sign-in methods confidential. You are responsible for everything that happens under your account.
- Tell us straight away if you suspect unauthorised use of your account.
- Do not create an account on behalf of someone else without their authority, or create a new account after we have suspended or closed one of yours.
5. Supplier verification and team accounts
Before a supplier can list stock, we verify their identity and business. Individuals provide a government-issued ID and a recent proof of address; companies provide their business registration, tax or VAT registration and the ID of an authorised signatory. We may ask for more information at any time.
We decide whether to approve an application, and we may decline one without giving detailed reasons. Approval does not mean we endorse a supplier or guarantee their stock.
Company suppliers can invite team members and give them roles for listings, orders and inspection, or finance. The account owner is responsible for the actions of every team member and for removing access when someone leaves.
Suppliers must keep their payout details accurate. We are not responsible for a payout sent to details a supplier gave us that turn out to be wrong.
6. Listing standards
Suppliers are responsible for their listings. Every listing must be accurate, honest and complete, and must include:
- genuine photos and a walkthrough video of the actual stock (for a representative listing, of stock of the same type and quality);
- the correct category, brands, gender, size range and quantity;
- an honest condition grade (A, A/B, B, B/C, C or A/B/C) as explained in our condition guide; and
- a price per piece in US dollars and, where offered, any sale price or quantity discount.
We review listings before they go live and may approve, reject or remove a listing, or ask for changes, at our discretion. Editing a live listing takes it off the marketplace until it has been reviewed again.
Suppliers must keep quantities up to date and must be able to supply everything they list. Listing stock you do not have, or selling the same stock elsewhere without updating the listing, is a breach of these Terms.
7. Prohibited items and conduct
Items you may not list or sell
- counterfeit, replica or unauthorised goods, or items that infringe anyone's trade marks, copyright or other rights;
- stolen goods or goods you do not have the right to sell;
- items subject to a safety recall, or that are hazardous, contaminated or infested;
- items whose sale, export or import is prohibited or restricted by law, sanctions or trade controls; and
- anything that is not apparel, footwear or fashion accessories in line with the categories on the Platform.
Things you must not do
- misrepresent stock, its condition or its origin, or use photos or videos that do not show the stock being sold;
- arrange or complete a sale that started on BalePick outside the Platform, or share phone numbers, email addresses, links or social handles to do so;
- manipulate prices, offers, reviews or rankings, or leave reviews that are not based on a genuine transaction;
- harass, threaten or abuse anyone, including other users and BalePick staff;
- upload malicious code, probe or disrupt the Platform, or access it by automated means (including scraping) without our written permission; or
- use the Platform for money laundering, fraud or any other unlawful purpose.
8. Offers, deals and handpick requests
Buyers may buy at the listed price or make an offer. An offer is a firm proposal to buy the stated quantity at the stated price. The supplier may accept, decline or counter it; a buyer may accept or decline a counter.
When an offer is accepted, the agreed deal is held for the buyer for 48 hours. The buyer must check out within that time to buy at the agreed price; after it, the deal lapses. Offers on an exact lot always cover the whole lot.
A handpick request asks a supplier to select a custom bundle for a buyer. The supplier may accept or decline, agree a date, build the selection and send an agreement. Once the buyer confirms, a bundle is reserved for that buyer only and must be bought before it lapses.
A supplier may withdraw a reserved bundle only for a good reason, such as stock being damaged or lost, and must say why. Contact details in handpick notes and agreements are hidden, as they are in messages.
9. Prices, checkout and payment
Every price on the Platform is set, charged and paid out in US dollars. You can choose a display currency to see an approximate conversion while you browse; those conversions use rates set by BalePick, are for information only and are not what you are charged.
At checkout we show the items, the shipping for your route and the estimated import duty as separate lines, and the total you will pay. Your order is placed when payment is authorised and we confirm the order.
Card payments are processed by our payment provider. We do not store your full card number. Store credit on your account can be applied at checkout.
Import duty shown at checkout is an estimate based on your delivery country. Customs authorities make the final assessment, and any additional duties, taxes or fees they charge on import are the buyer's responsibility unless we tell you otherwise for your order.
A supplier may decline an order they cannot fulfil. If an order or part of it is declined or cancelled before it ships, we refund the affected amount, including its share of shipping and duty.
BalePick collects payment for orders and holds each supplier's share until it becomes payable under section 12. Holding payment is how we protect both sides of a trade; it does not make BalePick a bank, and no interest is paid on amounts held.
10. Hub inspection, shipping and delivery
When an order is confirmed, the supplier prepares it and sends it to a BalePick hub within the time we set. At the hub, we inspect the order against its listing: we check the quantity and grade and record photos and video. A QC report is available for the order.
If an order does not pass inspection, we may hold it, ask the supplier to correct it, adjust or cancel it, and refund the buyer in whole or in part. We will tell both the buyer and the supplier what we have decided and why.
After inspection we arrange delivery to the buyer's address. Delivery times are estimates and can be affected by customs, carriers and events outside our control. Buyers must give a complete and correct delivery address and be available to receive the shipment.
Inspection reduces risk but cannot find everything: it samples and grades pre-loved stock and is not a guarantee of the condition of every piece. It does not replace a buyer's right to report a problem.
Our Shipping & Delivery Policy explains delivery in plain language. Read the Shipping & Delivery Policy
11. Reporting a problem, refunds and store credit
If something is wrong with an order — for example it is damaged, not as described, the wrong item or short in quantity — the buyer must report it through the Platform within 5 days of delivery, with a clear description and supporting photos or video.
The supplier has 3 days to respond. The buyer and supplier may agree a resolution between them; if they do not, or the supplier does not respond, the report comes to BalePick and we decide the outcome based on the listing, the QC report and the evidence.
Outcomes can include a full or partial refund, a return of the goods for a refund, or closing the report with no refund. If we ask for goods to be returned, the buyer must return them in the condition received and as we instruct.
Refunds are made to the original payment method or as store credit, as shown in the outcome. Card refunds can take several business days to appear, depending on your bank.
Store credit is held in US dollars, can only be spent on the Platform, has no cash value and cannot be transferred. We may correct store credit that was added in error.
Nothing in these Terms removes rights you have under laws that cannot be excluded by contract.
Our Refund & Returns Policy explains these rules in plain language. Read the Refund & Returns Policy
12. Fees and supplier payouts
Listing stock on BalePick is free. When a sale completes, BalePick deducts a commission and a platform fee from the supplier's payout. The current rates are shown on our Pricing page and in the listing form before a listing is saved.
A supplier's payout becomes payable after the order has been delivered and the buyer's 5-day report window has closed with no open report. Payouts are made in US dollars to the payout details on the account.
If a refund, return or other amount is owed by a supplier — for example after a buyer's report is upheld — we may deduct it from current or future payouts, or ask the supplier to pay it.
We may hold a payout while a report, chargeback, investigation or suspected breach of these Terms is open. Suppliers are responsible for their own taxes on the income they earn through the Platform.
Buyers pay no platform fee. Buyers pay the price of the goods, shipping and estimated import duty, as shown at checkout.
13. Messages, calls and communications
Buyers and suppliers can message each other, and make voice or video calls where available, through the Platform. Keep communication about orders on BalePick so that it can be referred to if something goes wrong.
To protect everyone, messages and notes are automatically screened. Phone numbers, email addresses, links and social handles are hidden, and attempts to share them are recorded. Repeated attempts may lead to restrictions on your account.
The BalePick team may join a conversation to help resolve a question or a report, and may review messages, calls records and attachments to investigate fraud, disputes or breaches of these Terms.
We send service messages about your account and orders by email, in-app notification and push notification. These are part of the service and you cannot opt out of them while you have an account, though you can control push notifications on your device.
14. Reviews and content you share
After an order, buyers and suppliers may review each other. Reviews must be honest, relevant and based on the actual transaction. We may remove reviews or other content that breach these Terms or the law.
You keep ownership of the photos, videos, text and other content you upload. You grant BalePick a worldwide, non-exclusive, royalty-free licence to host, copy, display, adapt (for example resize or crop) and use that content to operate, promote and improve the Platform, for as long as it is on the Platform and as needed afterwards for records and disputes.
You confirm that you have the rights to the content you upload and that it does not infringe anyone else's rights.
15. Intellectual property
The Platform, its design, software, text, graphics and the BalePick name and logo belong to BalePick or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute or use them except as needed to use the Platform as intended.
If you believe content on the Platform infringes your rights, contact us with details of the content and your rights, and we will review it promptly.
16. Restriction, suspension and closure
We may restrict, suspend or close an account, remove listings or hold payouts if we reasonably believe that a user has breached these Terms, created risk for other users or for BalePick, or acted unlawfully, or where the law requires us to.
- A restricted account can complete orders already in progress but cannot make new offers, orders or listings.
- A suspended account cannot sign in, and its listings are taken off the marketplace.
- Where appropriate, we will tell you the reason and give you a chance to respond.
You may close your account at any time by contacting us, once your open orders, reports and payouts are settled. Sections that by their nature should survive closure — including payment obligations, content licences, disclaimers, limitation of liability and governing law — continue to apply.
17. Disclaimers
Pre-loved goods are used goods. Grades and descriptions are given in good faith by suppliers and checked by sampling at our hub; natural variation between pieces is expected, especially in representative listings.
To the fullest extent permitted by law, the Platform is provided "as is" and "as available". We do not promise that it will always be available, uninterrupted or free of errors, or that any particular volume of sales or stock will be achieved.
18. Limitation of liability
To the fullest extent permitted by law, BalePick is not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill or data, arising from your use of the Platform.
Our total liability to you for all claims arising from or relating to the Platform or these Terms in any 12-month period is limited to the greater of (a) the fees you paid to BalePick in that period and (b) the amount of the order the claim relates to.
Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot be limited by law.
19. Indemnity
You agree to compensate BalePick, our officers, employees and partners for any claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms, your listings or content, or your violation of any law or of anyone else's rights.
20. Changes to these terms and the platform
We may change the Platform and these Terms from time to time — for example to reflect new features, legal requirements or how the marketplace operates. We will post the updated Terms on this page with a new "last updated" date and, for material changes, give you reasonable notice by email or in-app.
Changes do not affect orders placed before they take effect. If you continue to use the Platform after a change takes effect, you accept the updated Terms.
21. Governing law and disputes
These Terms, and any dispute arising from them or from the Platform, are governed by the laws of New Mexico, USA.
If you have a complaint, please contact us first — most issues are resolved quickly that way. If a dispute cannot be resolved informally within 30 days, it will be submitted to the exclusive jurisdiction of the courts of New Mexico, USA, unless the law of your country gives you the right to bring proceedings elsewhere.
22. General
- These Terms, together with our Privacy Policy, Cookie Policy and any policies referred to in them, are the entire agreement between you and BalePick about the Platform.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your rights under these Terms without our consent. We may transfer ours to a company that takes over the Platform.
- We are not responsible for delays or failures caused by events outside our reasonable control.
- These Terms are written in English. If they are translated, the English version prevails.
